Most consumers only experience with the insurance industry is through contact with their insurance agent. When a claim occurs most individuals reach out to their agent to help them through the claim process. Unfortunately insurance agents are merely salespeople for their insurance companies and do not handle claims. Insurance claims are handled by insurance adjusters. The law in most states requires insurance companies to pay claims promptly. However insurance companies have the right to investigate claims and frequently invoke certain provisions of your insurance policy that delay the claim process. During the claim process the insurance company has the right to demand certain documents from you and may require a sworn statement from you before addressing whether or not they will honor your claim. Failure to provide certain documentation and to appear at the statement requested by your insurance company may severely jeopardize your claim. Many times the insurance company adjuster will request for you to provide an examination under oath at their attorneys’ office. Without proper representation seemingly innocuous questions have implications and may elicit responses that will jeopardize the value of your claim. A prolonged investigation can delay your claim at a crucial time when you need to get your business back on track.
Most states have laws that require insurance policies (contracts) to be written in plain, direct and simple language. However, the reality is that these policies are contracts drafted by the insurance companies lawyers and are very complex and confusing to individuals who are not familiar with them. The insurance adjuster has been trained to read and interpret these insurance policies. An insurance adjuster will resolve all policy interpretations in favor of the insurance company. This is true even when state laws require that all policy interpretations be resolved in favor of coverage for the insured, YOU!
